Definitions and Interpretation

In this Agreement the following terms shall have the following meanings:

Custom Web Programming	This refers to any work which is specified and requested by the customer. It does not include any standard released software code and is usually specific to the customer’s requirements.
License	This relates to the agreement between the licensor (MyVirtualBuy.com) and the licensee (the end user).
License Pack	This refers to the purchasable license options available from MyVirtualBuy.com.com
Registration Key	This refers to a key that is used to register the licensed product to your chosen domain names.

Online Store Terms and Conditions

Your agreement to comply with and be bound by these Terms and Conditions is deemed to occur upon your first use of the Web Site. By continuing to use this Web Site you represent and warrant that:

if you are buying on behalf of your employers, you have the authority to submit Payment Information where any such authority is required; and

Your creation of an Account is further affirmation of your representation and warranty.

8. Termination and Cancellation
Either MyVirtualBuy.com or a User may terminate an Account. If MyVirtualBuy.com terminates your Account an explanation for the termination can be requested in writing by sending an email to info@MyVirtualBuy.com . Notwithstanding the foregoing, we reserve the right to terminate without giving reasons.

9. Payment
Any and all invoices are due for payment on/by the date shown on the invoice, unless alternative arrangements have been agreed between the Purchaser and MyVirtualBuy.com (Madejski Trading Ltd.).

10. Goods, Pricing and Availability
Whilst every effort has been made to ensure that all graphical representations and descriptions of Goods available from MyVirtualBuy.com correspond to the actual Goods, MyVirtualBuy.com and/or Madejski Trading Ltd. is not responsible for any variations from these descriptions, or the Purchaser's interpretation of these descriptions. This does not exclude our liability for mistakes due to negligence on our part and refers only to variations of the correct Goods, not different Goods altogether.
All pricing information on the Web Site is correct at the time of going online. MyVirtualBuy.com reserves the right to change prices and alter or remove any special offers from time to time and as necessary. All pricing information is reviewed and updated from time to time, when MyVirtualBuy.com and/or Madejski Trading Ltd. feels it appropriate.

11. Property, Risk and Account of Profits
Goods will not pass to the Purchaser until the full purchase price for those Goods has been received by MyVirtualBuy.com. Goods remains with MyVirtualBuy.com until payment is complete.
If the Purchaser sells the Goods on to its own customers in any form, either as purchased from MyVirtualBuy.com or forming a component part of a larger Good, and any amount of the purchase price payable to MyVirtualBuy.com remains outstanding, the Purchaser must account to MyVirtualBuy.com for the proceeds of such a sale. The Purchaser is then required to hold such proceeds on trust for MyVirtualBuy.com until payment has been received in full by MyVirtualBuy.com.

12. Delivery
MyVirtualBuy.com will notify you by way of email or immediate online reply when your goods are available to you.

13. Refund Policy
MyVirtualBuy.com will not refund any purchases of any sort where by the Purchaser has made a purchase of one or multiples of the following:

MyVirtualBuy.com Core Framework, once the product has been registered with the provided license key or commercial version of product has been downloaded.
Any support options, this includes single or multiple support instances or unused support incidents.
Any MyVirtualBuy.com extensions.
Any MyVirtualBuy.com service, such as website design or support related such as the installation service.
Third-party vendor products. Refunds for these services should be raised with the third-party vendor.
Nor will a refund be given under the following circumstances:

Configuration of your server does not meet the component's requirements (e.g. memory or script run-time configuration).
The component works not in a way you had expected it to work. That means that if the stated functionality you desire exists, but work differently than you imagined.
Our working hours are not compatible with yours or you request support on weekends and you cannot be supported on time.
You simply want your money back.

Applications for refunds which are not covered by any of the above reasons, should be submitted no later than 10 days from date of purchase. Any applications which exceed 10 days will be automatically refused.

14. Registration Allocation
MyVirtualBuy.com registration is non-renewable and permanent, this means once you purchase MyVirtualBuy.com digital product license, you will be allocated a registration key that will allow you to install MyVirtualBuy.com digital product onto a chosen computer/s this key will not expire or need to be renewed. Registration is allocated on a per computer basis and once assigned to your chosen computer/s (up to 2 computers) can be assigned. Once a registration key is allocated to a computer it cannot be altered or revoked. Changing your computer will require MyVirtualBuy.com digital product license to be purchased for the new computer.

Users and Purchasers will be bound by any changes to the Terms and Conditions from the first time the Web Site is used by them following the changes. If Madejski Trading Ltd. / MyVirtualBuy.com is required to make any changes to Terms and Conditions relating to sale of Goods by law, these changes will apply automatically to any orders currently pending in addition to any orders placed by Purchasers in the future.

Nothing in these Terms and Conditions excludes or restricts Madejski Trading Ltd. liability for death or personal injury resulting from any negligence or fraud on the part of MyVirtualBuy.com.
Nothing in these Terms and Conditions excludes or restricts Madejski Trading Ltd. liability for any direct or indirect loss or damage arising out of the incorrect delivery of Goods or out of reliance on incorrect information included on the Web Site.

Whilst every effort has been made to ensure that these terms and conditions adhere strictly with the relevant provisions of the Unfair Contract Terms Act 1977, in the event that any of these terms are found to be unlawful, invalid or otherwise unenforceable, that term is to be deemed severed from these terms and conditions and shall not affect the validity and enforceability of the remaining terms and conditions. This term shall apply only within jurisdictions where a particular term is illegal.

These terms and conditions and the relationship between you and Madejski Trading Ltd. / MyVirtualBuy.com shall be governed by and construed in accordance with the Law of Republic of Cyprus and Madejski Trading Ltd. and you agree to submit to the exclusive jurisdiction of the Courts of Republic of Cyprus.
